APRx impact in regulatory arena

I am testifying on your behalf today at a TSBP hearing on proposed rules regarding pharmacist presence in the pharmacy and physical security. After TSBP's response to our comments the first time they published the rules not only missed the mark but added to the onerous nature of the rules, we requested this hearing.
 
The bottom line regarding pharmacist presence in the pharmacy is that no prescription can leave the pharmacy without the pharmacist's approval. Adding layers of bureaucracy to the existing state and federal regulations is expensive to enforce and insults the pharmacist's professionalism.
 
And we have serious concerns about the cost to small business independent pharmacy to meet the structural requirements. The question remains as to what to do with existing pharmacies purchased by a new owner? Will the rules mandate retrofitting, or will the grandfather clause apply?
 
Texas Medicaid
No doubt you remember the problems caused by the sudden unavailability of Tylenol or its generics when McNeil pulled out of the CMS rebate program. Neither CMS nor Texas Health and Human Services Vendor Drug Program notified pharmacists or vendors of the change.
 
We ran interference for you with Texas Medicaid, but found it difficult to get a direct answer to our urgent questions. So we communicated with the staff of the House Human Services and the Senate Health and Human Services committees, as well as staff in the lieutenant governor's and speaker's offices.
 
Obviously we had a positive impact because last week when the FDA recalled all strengths of Digitek due to some concerns about product potency, it was handled differently. This time the Vendor Drug Program checked with various wholesalers about the availability of other generics and the name brand Lanoxin and removed the MAC on Lanoxin so it will pay without "brand necessary" on the original Rx.
 
NCPA 40th Annual Conference on Legislation and Government Affairs
APRx Chairman Lynn Everett, RPh, Vice Chairman Vance Oglesbee, RPh, and I will attend the National Community Pharmacists Association legislative conference May 19-21. While in D.C., we will visit with Texas congressional offices about the top three national issues: Medicaid AMP fix legislation, Medicare Part D Prompt pay, and HR 971 pharmacy business negotiations bill.

Round 2 of DMEPOS bidding
Suppliers/providers who plan to participate in second round of competitive bidding for DMEPOS, in particular those in the McAllen-Edinburg-Mission, Austin-Round Rock, Beaumont-Port Arthur, San Antonio, El Paso, and Houston-Sugar Land-Baytown areas, must submit applications for accreditation by May 14, 2008. This also applies to bidders in New Orleans-Metairie-Kenner and Baton Rouge, LA, and Oklahoma City and Tulsa, OK regions.
 
We posted an article by CMS regarding necessary steps to ensure supplier number and Authorized Official information is current with the National Supplier Clearinghouse and that bidders are registered in the CMS security system known as the Individuals Authorized Access to CMS Computer Services (IACS). It also is on the CMS MLN Website.
 
Time limit extended on Schedule II scripts
A Texas pharmacy now has 21 days from the prescription date to dispense Schedule II medications, according to the Texas Department of Public Safety.
 
Amendments to Chapter 13, Subchapter D, §13.75, no longer allow a pharmacy to call a physician and change the date on an official prescription for a Schedule II drug. If an official prescription is presented later than 21 days after issuance, a new prescription is required. The amendments became effective March 12.
Is your NPI up to date?
CMS will lift its National Provider Identifier contingency plan May 23, and only accept the NPI on all HIPAA electronic transactions. A transmission containing a legacy identifier on or after May 23 will result in a rejected claim.
 
Check the status of your NPI with NCPDP, go online. To apply for a NPI, go to the CMS Website or call CMS at 800-465-3203. You must report your NPI to NCPDP by filling out an application. Remember to also register your NPI with your switching and/or software vendor.
 
CMS will host a national NPI Roundtable 1:30 - 2:30 CDT May 14 to address additional questions from the Medicare provider community regarding Medicare's NPI implementation. Providers can submit questions through the online registration system at the time of sign up for the call.
